Terms and Conditions For SoulSync AI : Kiss & Hug

These Terms and Conditions ("Terms") govern your use of SoulSync AI : Kiss & Hug (the "App"), available on iOS and Android.

By downloading, accessing, or using the App, you agree to these Terms.

If you do not agree with these Terms, please do not use the App.

1. Use of the App

SoulSync AI : Kiss & Hug provides AI-powered creative features that allow users to create images and videos using photos or other media selected by the user.

You may use the App only for lawful purposes and in accordance with these Terms.

You are responsible for your use of the App and any content you upload, create, save, or share.

2. AI-Generated Content

The App uses artificial intelligence to generate images and videos based on content provided by the user.

AI-generated results may not always be accurate, realistic, or predictable.

You understand and agree that:

  • AI-generated results are created automatically;

  • Results may contain unexpected or inaccurate elements;

  • We do not guarantee that generated content will meet your expectations;

  • AI-generated content should not be considered factual or authoritative;

  • You are responsible for reviewing generated content before using or sharing it.

We are not responsible for decisions or actions you take based on AI-generated content.

3. User-Uploaded Content

You may upload photos, videos, or other media to use certain features of the App.

You remain responsible for the content you upload.

By uploading content, you confirm that:

  • You have the necessary rights or permissions to use the content;

  • Your upload does not violate another person's rights;

  • Your upload does not violate applicable laws;

  • You have obtained appropriate permission where required by law.

You should not upload content that you do not have permission to use.

4. Prohibited Content and Use

You may not use SoulSync AI : Kiss & Hug to create, upload, distribute, or share content that:

  • Is illegal or promotes illegal activities;

  • Infringes copyright, trademark, privacy, publicity, or other rights;

  • Contains child sexual abuse or exploitation;

  • Sexualizes or exploits minors;

  • Promotes serious violence or wrongdoing;

  • Impersonates another person for fraud or deception;

  • Is intended to harass, threaten, defame, or harm another person;

  • Contains malicious software or harmful code;

  • Attempts to bypass or abuse App security;

  • Violates applicable laws or regulations.

We may restrict, suspend, or terminate access to the App if we reasonably believe these Terms have been violated.

5. Images of Other People

If you upload a photo containing another person, you are responsible for ensuring that you have the necessary permission or legal basis to use that person's image where required.

You must not use the App to create misleading, abusive, or harmful content involving another person.

You are responsible for how you use, save, or share generated content.

6. Your Responsibility for Generated Content

You are solely responsible for content generated using the App.

Before sharing generated content publicly or commercially, you should ensure that its use does not violate:

  • Applicable laws;

  • Copyright or trademark rights;

  • Privacy rights;

  • Publicity rights;

  • Any other person's legal rights.

We do not guarantee that generated content is free from third-party rights or claims.

7. Content Processing and Storage

Some AI features require uploaded photos or videos to be processed on our servers.

Uploaded source media, generated videos, and temporary processing files are automatically deleted from our servers within 7 days.

If you download or save generated content to your device, you are responsible for that copy.

8. Ownership and License

You retain ownership of photos and videos that you upload to the App, subject to any rights belonging to third parties.

To provide AI features, you grant us a limited, temporary license to access, process, transmit, and store your uploaded content only as reasonably necessary to provide the requested service.

This license ends when the relevant processing and temporary storage are completed, subject to the applicable retention period described in our Privacy Policy.

We do not claim ownership of your uploaded photos or videos.

9. In-App Purchases and Coins

SoulSync AI : Kiss & Hug may offer one-time in-app purchases that provide users with virtual coins.

One-Time Purchases

Our paid plans are one-time purchases. A purchase does not automatically renew unless the App clearly states otherwise.

After a successful purchase, the specified number of coins will be added to your account and may be used to create AI-generated videos or access other eligible features.

Coins

Coins are virtual items used within the App.

  • Coins can be used only within SoulSync AI : Kiss & Hug.

  • Coins have no monetary or cash value.

  • Coins cannot be exchanged for cash.

  • Coins cannot be transferred, sold, or given to another user.

  • The number of coins required to generate a video may vary depending on the selected feature.

  • We may change the number of coins required for a feature where permitted by applicable law.

  • Purchased coins do not represent money stored in an account or wallet.

Purchase Verification

Purchases are processed through the Apple App Store or Google Play.

We may verify transactions with the applicable app store to confirm that a purchase was successfully completed.

If a purchase is successfully verified, the applicable coins will be credited to your account.

Restoring Purchases

Where supported, eligible purchases may be restored using the App's restore-purchase functionality.

Restoration may require verification through Apple or Google.

Refunds

Refunds are handled according to the applicable Apple App Store or Google Play policies.

We do not directly process or store your complete payment card information.

10. Changes to Paid Features

We may add, modify, or remove paid features, credit packages, or other paid offerings where permitted by applicable law.

We will not intentionally remove purchased benefits in a manner that violates applicable law.

11. Advertisements

The App may display advertisements provided by third-party advertising services, including Google AdMob.

We are not responsible for the content, availability, or accuracy of third-party advertisements.

Your interactions with advertisers may be subject to the advertiser's own terms and privacy policies.

12. Analytics

We may use Google Firebase Analytics to understand App usage, monitor performance, identify technical problems, and improve the App.

The collection and use of analytics information are described in our Privacy Policy.

13. App Availability

We aim to keep the App and its AI features available and reliable, but we do not guarantee uninterrupted availability.

Features may occasionally be unavailable because of:

  • Server maintenance;

  • Technical problems;

  • Network failures;

  • Third-party service issues;

  • Software updates;

  • Security incidents;

  • Circumstances beyond our reasonable control.

We may modify, suspend, or discontinue features where permitted by applicable law.

14. Intellectual Property

The App, including its software, design, branding, interface, logos, text, graphics, and other original materials, is owned by or licensed to us and is protected by applicable intellectual property laws.

You may not:

  • Copy or reproduce the App;

  • Modify or reverse engineer the App;

  • Distribute or resell the App;

  • Attempt to extract the source code;

  • Use our branding without permission;

  • Use the App to build a competing service without authorization.

15. Third-Party Services

The App may rely on third-party services, including:

  • Google Firebase;

  • Google AdMob;

  • Apple App Store;

  • Google Play;

  • Hosting and infrastructure services.

Third-party services may have their own terms and privacy policies.

We are not responsible for services independently operated by third parties.

16. Privacy

Your use of the App is also subject to our Privacy Policy.

Our Privacy Policy explains how we collect, process, use, store, and protect information.

17. Account and Access Restrictions

If the App provides accounts or authentication, you are responsible for maintaining the security of your account information.

You must not attempt to access another user's account or interfere with the App's security or operation.

We may suspend or terminate access if you violate these Terms or misuse the App.

18. Disclaimer

To the maximum extent permitted by applicable law, the App is provided on an "as available" and "as is" basis.

We do not guarantee that:

  • The App will always operate without interruption;

  • AI results will always be accurate or suitable;

  • Generated content will always meet your expectations;

  • The App will always be free from errors or technical issues.

Nothing in these Terms excludes rights or protections that cannot legally be excluded.

19. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be responsible for indirect, incidental, special, consequential, or similar damages arising from your use of the App.

This may include loss of data, loss of profits, loss of business opportunities, or other losses resulting from the use or inability to use the App.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

20. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, damages, liabilities, and expenses arising from:

  • Your violation of these Terms;

  • Your misuse of the App;

  • Content you upload or generate;

  • Your violation of another person's rights;

  • Your violation of applicable laws.

21. Termination

We may suspend or terminate your access to the App if you violate these Terms or misuse the App.

You may stop using the App at any time by uninstalling it from your device.

Termination does not affect provisions that are intended to survive termination, including intellectual property, disclaimers, limitations of liability, and user responsibilities.

22. Children's Use

SoulSync AI : Kiss & Hug is not intended for children under the age of 13.

Users must not use the App in violation of applicable age restrictions or laws.

23. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the Last Updated date at the beginning of these Terms.

Your continued use of the App after the updated Terms become effective means that you agree to the updated Terms.
